This subject provides and overview of dispute prevention, dispute management and dispute resolution in commerce, through the deal-making phase to the dispute settlement phase, including an understanding of the relevant contractual and legislative frames. The subject content reflects current issues and developments in key areas such as mandatory mediation, industry-based schemes and adaptation of dispute resolution processes suitable for e-commerce and more globally influenced commercial enterprises. It also considers the role of legislative changes and changes to corporate structures and cultures in the development of effective, accessible, cost efficient and equitable methods for dealing with commercial disputes. Overall, the subject encourages critical thinking and examination of current policy arguments, legal issues and the practice of commercial dispute resolution.
