Administrative law is dynamic and relevant to every individual and community in Australia. It is particularly relevant to all forms of government activity, including regulation of trade and commerce.
This subject deals with major themes and developments in modern administrative law by building on materials considered in administrative law at an undergraduate level. Participants review the functions, powers and obligations of the executive arm of government within the context of modern case studies. Particular attention is paid to developing forms of remedies, the alternative forms of review of administrative action through, for example, the Ombudsman, and current issues and prospective developments. Contemporary issues include challenges to freedom of information legislation, the right of the individual to privacy and the effectiveness of privacy legislation, the role of anti-corruption legislation, the concept of ministerial responsibility and responsible government, and the concept of administrative detention.
This subject aims to provide an understanding of:
- the key elements of judicial review
- contemporary developments, challenges and responses.
The subject also provides advanced skills in identifying and solving administrative law problems.
