This subject deals with the practicalities of civil litigation in New South Wales courts governed by the Civil Procedure Act 2005 and Uniform Civil Procedure Rules 2005, namely the Supreme Court, the District Court, the Local Court and the Dust Diseases Tribunal. Areas of study in this subject largely follow the subject matter in the Act and Rules, such as the commencement of proceedings, representation, the filing of court documents, service, pleadings and particulars, interlocutory applications, discovery, privilege and mediation.
The subject aims to provide both a theoretical and practical understanding of the workings of civil procedure in New South Wales, with a learning opportunity to:
- study practice and procedure as a field of academic endeavour
- apply and use the law in relevant factual situations
- identify and discuss ethical and practice-based issues that arise in civil litigation
- develop both written and oral skills in litigation and alternative dispute resolution.
The subject is taught by a weekly lecture (1.5 hours) and tutorial (1.5 hours).

Students who enrolled in a Bachelor of Laws before 2008 and who choose not to complete practical legal training may elect to enrol in a substitute law option subject in place of this subject if they have completed 71005 Practice and Procedure.
