Undergraduate and Postgraduate
This subject deals with adjectival law and the policies underpinning the criminal justice system. In focusing on the formal procedural requirements, the subject deals critically with the efficacy of these requirements in relation to the fundamental tenets of the criminal justice system, for example procedural fairness, burden of proof.
The administration of criminal justice is studied under the following broad topic headings: Investigation, Pre-trial, Trial, Sentencing, Appeals and Victims of Crime.
This subject aims to provide:
- an overview of the criminal justice system in NSW and where relevant the Commonwealth
- an overview of the roles and relationships between institutions and participants in the criminal justice system, such as the police, the accused, lawyers, juries and judges
- an appreciation of the ethical obligations and issues that arise for various professional participants in the criminal justice system
- an appreciation of the involvement, obligations and participation of citizens within the criminal justice system
- the ability to critically consider the policy considerations that underpin the criminal justice system
- skills that link to legal practice, such as development of argument, oral and written communication and legal research
- students with the ability to critically evaluate the skills and experience they gain at university and link this to legal practice.
