This subject concentrates on a study of the general principles of insurance law, but does not examine in detail the special rules governing each class of insurance contract. After the nature of the contract of insurance is noted, key concepts are dealt with: insurable interest, indemnity and subrogation, risk, non-disclosure, misrepresentation, conditions, warranties and premium. Subsidiary matters such as assignment of policies, liens and reinsurance are considered. The role of insurance intermediaries in the formation of contracts of insurance is examined. The subject thus focuses on the legal rights and liabilities of parties to an insurance contract in the context of common law principles and statutory modification. In addition, consideration is given to the regulatory framework within which the insurance industry operates in Australia.
