This subject explores the skills necessary to present evidence and argument in court using the art of persuasion. The techniques of examination-in-chief, cross-examination, re-examination, making objections to evidence and presenting an opening and closing address are taught.

During the semester, students are involved in a number of workshops and online activities including the preparation of an interlocutory application in the District Court. All students prepare and present a Local Court mention, bail application, plea in mitigation and a defended hearing Practice Court. Off campus students must attend an intensive week at the end of the semester.

Assessment: The plea in mitigation and defended hearing are for Pass/Fail assessment. Students are also required to attend court and submit a short court journal of observations and analysis. There is also a test on objections to evidence that must be passed in order to pass the subject.
